These Terms and Conditions apply to all website design and maintenance services provided by [Raj Aryan – PHOENIX WEB DESIGN]. By commissioning a project, the Client agrees to the following:
1. Project Initiation & Timeline
● Content Policy: The project delivery timeline (7, 15, or 30 days) officially begins only after the Client has provided all necessary assets, including text, logos, high-resolution images, and required login credentials.
● Delays: Any delay in providing content will result in a day-for-day extension of the delivery date.
2. Payments & Fees
● Project Deposit: A non-refundable deposit of 50% is required to book a slot in the production calendar.
● Final Payment: The remaining 50% is due upon website completion but prior to the site going live or files being transferred.
● Renewal Fees: For “Business” and “Advance” plans, the first year of Domain, Hosting, and SSL is complimentary. Starting Year 2, a renewal fee of ₹4,000/year (plus any additional business emails) will be invoiced 14 days before expiry.
3. Scope of Work
● Custom Design: For Business and Advance plans, websites are custom-built. Significant changes to the design layout after the “Mockup Approval” phase may incur additional charges.
● Minor Updates (Monthly Plan): Clients on the ₹1,000/mo Care Plan are entitled to 60 minutes of maintenance per month (text changes, image swaps, small tweaks). Unused minutes do not roll over to the next month.
● Major Additions: Requests for new pages, new features (e.g., e-commerce functionality), or rebranding are considered out-of-scope and will be quoted separately.
4. Business Emails
● Setup: Each plan includes one (1) free business email setup. Additional emails are charged at ₹1,000/year per mailbox.
● Storage: The standard mailbox size is 10GB. If the Client exceeds this limit, they must upgrade to a Premium storage plan (50GB) at an additional cost.
● Support: I provide support for the initial setup and syncing of emails to one mobile and one desktop device. Ongoing troubleshooting due to local device issues is part of the Monthly Care Plan.
5. Ownership & Backups
● Client Ownership: Upon final payment, the Client owns the website and its content.
● Backups: While I provide a final project backup, ongoing monthly backups are only guaranteed for clients enrolled in the Monthly Care Plan. I am not liable for data loss on sites not maintained by me.
6. Termination of Service
● Non-Payment: If renewal fees or monthly maintenance fees remain unpaid for more than 15 days past the due date, services (including website and email) may be suspended.
● Cancellation: Either party may terminate the maintenance agreement with 30 days’ written notice.
7. Limitation of Liability
● I am not responsible for loss of business or profits due to server downtime (Hostinger), third-party API failures, or client-side errors. My liability is limited to the total amount paid for the specific service in question.

Client Acceptance
By making the initial deposit, the Client acknowledges they have read, understood, and agreed to these Terms and Conditions.
